Unifor Wins Navistar Court Appeal

A win for former Navistar employees in Chatham waiting on possible pension payments.

The Divisional Court of Ontario has dismissed Navistar's opposition to paying retiree pensions totaling $28-million. The court upheld the findings of the Financial Services Tribunal made in its decisions the last 2-years, that were challenged by Navistar, that a broad based group of workers should be included in the windup of the pension plan.

Unifor National staff rep Jim Mitchell says it's certainly a positive ruling for his members. "These are basic rights that our members have under the pension legislation in Ontario, under a restructuring, and what ultimately became a closure," says Mitchell. "So we're urging Navistar to return to the bargaining table and finalize a closure agreement with our members."

Navistar has the right to appeal the decision, but it has to apply for permission to do so by July 18th.
