A $20-million lawsuit has been filed against the City of Windsor and the Greater Essex County District School Board.
Last May, 15-year-old Madison Arseneault tripped over a wire at the Ford Test Track and was impaled with the shaft of a golf club which fractured her skull. The brain injury has caused partial paralysis, cognitive impairment and chronic pain.
Lawyer Jennifer Bezaire says as a result of the injuries, Arseneault has large medical bills and her life has been changed forever.
"The intent is to recover damages to pay for Madison's future care needs, including an attendant to provide the care she requires around the clock," says Bezaire.
The statement of claim filed Wednesday alleges the City of Windsor workers and school supervisors were negligent and the injury could have been avoided.
"Our investigation is still ongoing in terms of the amount of responsibility on each of them, we would say one or both of them are wholly responsible for what happened to Madison and that Madison certainly didn't do anything wrong in the circumstances," says Bezaire.
Both defendants will have the opportunity to file a statement of defense before the case proceedings begin.
