Ontario's law-enforcement watchdog agency has cleared Windsor police in an incident earlier this summer.
The Special Investigations Unit (SIU) found no grounds to charge an officer with an offence that included a serious injury suffered by a 43-year-old man in Amherstburg.
According to the report released Thursday, the incident took place shortly before 4 p.m. on June 21. Officers from Windsor police's Amherstburg detachment responded to a break-and-enter. The homeowners were engaged in a struggle with the suspect before the suspect fled. Police arrested him near the scene, and the suspect did not complain of injuries at that time.
After being transported to the police station and placed in a holding cell, the suspect began complaining about numb fingers and a sore arm. He was taken to hospital to be treated for a dislocated shoulder and a broken humerus. The report indicated that the suspect then mentioned he was injured during the arrest.
"After personally examining the complainant, and satisfied that his condition was more serious than simple soreness, the sergeant, with years of experience in teaching first-aid, proceeded to make arrangements for the attendance of EMS within a reasonable time," read the report.
SIU Director Joseph Martino concluded that the officers involved did not exceed reasonable force and there is no basis to proceed with criminal charges, thus closing the file.
