The sentencing of the youth who pleaded guilty to first degree murder of an 11-year-old girl in Holmesville will not be delivered until the end of the year.
Despite a desire from all parties to resolve the matter in a timely manner, Justice Marc Garson told the court there was an unexpected, but necessary delay in the process.
Justice Garson received an update on September 15 that the psychological assessment ordered under Section 34 of the Youth Criminal Justice Act (YCJA) would not be ready until November 13.
Originally, the sentencing was scheduled to move forward on October 13.
The next court date in the case is now set for November 20, so the report can be entered into the record and the matter can be spoken to.
As long as there are no other delays, the sentencing is scheduled to take place from December 14-17.
By then, the youth will have served more than 29 months of pre-sentence custody since his July 2024 arrest.
Under the YCJA, the maximum sentence for being found guilty of first-degree murder is 10 years, with a maximum of six years in custody and four served in community.
