An elderly Sarnia woman has been found guilty of dangerous operation of a motor vehicle causing death in a fatal crosswalk collision nearly three years ago.
Hilda Minnis, 82, looked on in a wheelchair as judgment was handed down in superior court Friday after a seven day trial.
Jillian Keck, 10, died after being struck by a car crossing Murphy Rd. at Cathcart Blvd. on her way to Cathcart School after lunch January 7, 2013.
Superior Court Justice Joseph Donohue said that a reasonable person with Minnis's medical history would have foreseen the risk, and stopped driving.
Hilda Minnis was first made aware of her limited peripheral vision on her left side during a 2011 doctors appointment, meaning that her field of vision did not meet Ministry of Transportation standards.
Justice Donohue said the fact there was no signs of braking before or after the collision confirms what Minnis had said, that she did not see the children or the crossing guard that day.
He says at the speed she was travelling, she should have been able to stop ahead of the Murphy Rd. crosswalk and that driving in her condition was putting those around her in danger.
Sentencing is scheduled for January 15, 2016.
The maximum sentence for dangerous driving causing death is 14 years in jail.
