An Amherstburg cyclist will be charged after a minivan hit him from behind in September, resulting in the amputation of his leg.
Police say Richard Orum, who is now suing the minivan driver, will be charged for not having a red light or reflector on the back of his bike.
His lawyer Jennifer Bezaire in the civil case says the charge "defies common sense" because he was "lit up like a Christmas tree." She says a large, bright light was attached to his backpack at the time of the collision.
The charges against Orum are pending. Previously Amherstburg police said he was served on November 12, however they have since clarified. This type of charge comes with a fine.
The driver of the minivan isn't facing any charges, Senior Constable Shawn McCurdy tells BlackburnNews.com.
On Tuesday, Orum retained Bezaire with Greg Monforton & Partners. The lawsuit will be launched in the coming months.
Orum's leg was amputated due to a severe injury. He will be in hospital for the "long haul" as he's recovering from several fractures.
It was the early morning hours of September 30 when Orum was struck while riding on Alma St.
