Man Accused Of Posing As Teen May Be Released Soon

The lawyer who is representing a South Sudanese man accused of posing as a teenage high school student, says he's working to have him released from jail soon.

Frank Miller says he's meeting with immigration officials today about setting a date to hear arguments in favour of releasing Jonathan Nicola.

"At the time that Mr.Nicola was before the adjudicator, I wasn't retained," says Miller referring to a hearing before the Immigration and Refugee Board of Canada last week. "He didn't really have a plan to put before them [the board], and now we do."

The pastor of St.Alphonsus Church is expected to offer surety.

Nicola is accused of supplying false documents to attain a student visa. His documents say he's 17-years-old, but U.S. border officials raised a red flag during a recent attempt to cross the border with his teammates on the Catholic Central High School basketball team. They say his fingerprints match that of a 29-year-old man.

Nicola has been in custody at the Southwest Detention Centre in Windsor since his arrest last month on charges of contravening the Immigration Refugee Protection Act.

There is a hearing to determine whether he could be deported on May 11. The case goes before the Canada Border Services Agency again on May 24.
