SIU ends Windsor investigation into woman's injury

Ontario's law-enforcement oversight agency has ended a probe involving Windsor police and an injury to a woman during an arrest in March.

The Special Investigations Unit (SIU) reported that on March 1, Windsor officers were called to a home at Little River Road and Lauzon Road. The homeowner had asked for help removing a woman who had been doing drugs in the basement.

The officers asked the woman to leave, but she returned to the home early the next morning. Police were called again, and the woman was arrested for trespassing. However, while the officer was applying handcuffs, the woman suddenly pulled an arm forward. When the officer pulled it back, it fractured.

The woman was treated in hospital for a broken arm.

SIU Director Joseph Martino said that while the injury was unfortunate, it did not warrant a criminal charge against the officer.

"While I accept that the force used by the SO [subject official] broke the complainant’s arm, there are no reasonable grounds to conclude that the injury was attributable to unlawful conduct on the part of the officer," wrote Martino in the public report. "As such, there is no basis for proceeding with criminal charges in this case. The file is closed."
