SIU closes investigation into overdose suffered in Windsor custody

Ontario's law-enforcement oversight agency has ended its probe into a drug overdose suffered by someone arrested by Windsor police.

In the late afternoon of August 2, Windsor officers were called to the area of Cabana Road and Dougall Avenue on a report of a man waving a knife at passing vehicles. The person had also allegedly pulled a fire alarm.

After being taken to police headquarters, the suspect admitted to having been taking methamphetamines. Soon after being placed in a cell, the suspect began feeling ill and told police that he had also taken fentanyl. He then lost vital signs and was rushed by ambulance to hospital, where he was treated for a drug overdose.

Special Investigations Unit (SIU) Director Joseph Martino noted in his report that the suspect was cared for while in custody.

"Cognizant of his drug use, the complainant was assigned a cell for high-risk detainees that would permit his custodians greater scrutiny of his condition," wrote Martino. "The moment the special constables realized the complainant was at even higher risk than had initially been thought following the news about his fentanyl use, they and the SO (subject official) acted with dispatch to contact paramedics to have him taken to hospital."

Martino said there was no evidence that officers committed a criminal offence, and the file is now closed.
