Accused murderer continues to have mental health assessed

A man accused of a murder in Tilbury will have another psychiatric assessment to determine if he could be considered criminally responsible.

Ken Baylis, 34, was before the Ontario Court of Justice in Chatham on Monday morning and was ordered to undergo a third mental health assessment at the request of southwestern Ontario psychiatrist Dr. William Komer. The first psychiatric mental health assessment order was issued in January 2024.

Defence lawyer Greg McGivern told the court the 60-day assessment will be at a psychiatric hospital in either St. Thomas or Penetanguishene, depending on the availability of beds. McGivern said Baylis will be added to a waitlist.

Baylis' case will be back in court June 26, 2024 for an update on the status of the beds at the psychiatric hospitals.

Baylis was charged with second-degree murder in April 2023 after Daniel Marchand, 45, was reported missing and later found dead at a home on Dufferin Avenue in Tilbury.

Discussions continue between the defence and the Crown to resolve the case.

The case is under a publication ban and evidence cannot be reported.

Police previously said a post-mortem examination was completed and the preliminary cause of death was determined to be homicide.
