The Law Society Tribunal of Ontario has scheduled conduct hearings for two Windsor lawyers.
According to the online database from Martindale, lawyers Claudio Martini and Maria Frances Marusic had worked for the Windsor law firm of Shulgan, Martini & Marusic, LLP. Conduct hearings with the tribunal were scheduled via videoconference Monday and Tuesday of this week.
In the notice of application for Martini, he is accused of professional misconduct for instances going back to 2002. Among the allegations, Martini borrowed money from at least three clients, then proceeded to mislead them about legal action. He was also accused on at least one occasion of withdrawing funds from settlements or trusts without the knowledge or permission of the client.
Martini also, in 2015 and while under suspension, continued to practice law by assisting with trial preparation for a client.
Under Marusic's notice of application, she was accused in 2012 and 2013 of misappropriating over $1.26-million in a client's trust fund. In 2015, the Law Society also charged Marusic with failing to prevent the practice of law by Martini and associating with him without the knowledge or permission of a committee of convocation.
A Google search indicated that the law firm, situated at 2491 Ouellette Avenue, is permanently closed.
