A Windsor man found guilty of charges connected to a fatal crash near Chatham in 2022 has been sentenced to serve jail time.
Brett Iler, 30, was sentenced to serve 40 days in jail and had a four year driving ban imposed. However, he will not serve any probation on this matter as he is already under probation for a previous matter, won't have to pay a fine because he is receiving Ontario Works benefits, and won't serve any community service.
The sentence was handed out in Provincial Offences Court in Blenheim on Wednesday morning by Justice Kelly Jackson.
The prosecution was recommending 10-12 months of jail and a five-year driving prohibition. The defence was pushing for a fine of $5,000 to $7,000, a four-year driving ban, two years probation, and 200-300 hours of community service, adding that sending Iler to jail won't serve anybody.
The 30-year-old Windsor man was found guilty of careless driving causing death and careless driving causing bodily harm on November 29, 2024 after a crash on May 27, 2022 at Queen's Line and Dillon Road near Chatham that killed two people during a Retrofest Classic Car Cruise.
Nigel Sedge and Jaimee Doyle died when Iler veered into oncoming traffic. The crash also severely injured Colin Chinnick, Brian Griffith, and Jaimee's husband Kyle. They all suffered broken bones and other injuries.
The court heard that Iler has a distracted driving conviction on his driving record and is currently under probation for uttering threats.
He also has a history of substance use and mental health issues. Iler was previously diagnosed with a personality disorder.
Justice Jackson told the court that she believes Iler is remorseful, but she couldn't overlook the tragic consequences of the fatal crash and couldn't ignore the grief felt by the families.
